TERMS AND CONDITIONS
The following terms and conditions apply to all purchases of ebooks from this site unless special arrangements are negotiated. All purchases shall be completed on-line and paid for by credit card. There will be no cash sales and no physical delivery except by special arrangement.
All ebooks will be delivered by email to the email address provided by the purchaser when setting up their account. Ebooks will be delivered in individual emails to avoid rejection due to over-size attachments. It is possible that special arrangements may have to be made with your ISP to raise the allowed size so as to allow certain attachments to be forwarded.
CLAIMING NON-RECEIPT OF GOODS
Claims for missing ebooks should be made within 10 days of the purchaser noticing that the ebook was not received.Mandamus will re-send the missing document to the purchaser's email account.
SUBSCRIPTION, OR STANDING ORDER
Mandamus does not provide a subscription or standing order service.
Except for the Statutes and Regulations listed below, any ebook purchased will be replaced with its amended version, if the amendment is published within one year of the original purchase date. Only one replacement will be made under this provision. For this purpose the date upon which the amended statute or regulation is published by the Department of Justice, Canada at http://laws-lois.justice.gc.ca

LIMITATION OF WARRANTY AND LIABILITY
Mandamus Publishing Inc. disclaims any representations, warranties or conditions, express or implied, including those of performance or merchantability or fitness for a particular purpose with respect to the features and text contained in the ebooks. Although every effort is made to ensure that the exact text of the government website is copied and transmitted, no warranty is made that the text is exact. These ebooks are not official copies as that term is defined by the Government of Canada and the Province of Ontario. Mandamus Publishing Inc. adds navigational features to the text but does not warrant that the features added or that the intended effect of the features will work as expected. The manner in which navigational features such as embedded anchors and links work is actually wholly dependent upon the capabilities of the e-reader software used by the purchaser. Ebook reader software which has been tried and which appears to work properly, is listed in the FAQ.
Mandamus Publishing Inc. will not be liable for any loss or injury arising out of or caused, in whole or in part, by any alleged negligent act or omission in procuring, compiling, amending and creating any ebook or in delivering the ebook to the purchaser, and in particular shall not be liable for any indirect, consequential, punitive or special damages of the purchaser or of any other party claiming against the purchaser, including, without limitation, damages for loss of profits or revenue or failure to avoid loss, in any manner. Notwithstanding anything to the contrary in this agreement or any statute or rule of law to the contrary, the cumulative liability of Mandamus Publishing Inc. for all claims arising out of or in connection with this agreement whether directly or indirectly, including, without limitation, from or in connection with the use or improper functioning of the ebook shall not exceed all fees paid to Mandamus by the Purchaser for the ebook. Mandamus is not engaged in rendering legal, accounting or other professional advice. If legal advice or other expert assistance is required, the services of a competent professional should be sought.
Copyrights in the Actsa nd Regulations of the Government of Canada are held by the Queen's Printer for Canada. These ebooks are published by Mandamus Publishing pursuant to the Reproduction of Federal Law Order, SI-97-5which states:
"Anyone may, without charge or request for permission, reproduce enactments and consolidations of enactments of the Government of Canada, and decisions and reasons for decisions of federally-constituted courts and administrative tribunals, provided due diligence is exercised in ensuring the accuracy of the materials reproduced and the reproduction is not represented as an official version."
Copyrights in the Acts and Regulations of the Province of Ontario are held by the Queen's Printer for O ntario. These ebooks are published by Mandamus Publishing pursuant to the policy of the Queen's Printer which states in part:
"The Queen's Printer for Ontario holds copyright in Ontario statutes, regulations and judicial decisions. The Queen's Printer permits any person to reproduce the text and images contained in the statutes, regulations and judicial decisions without seeking permission and without charge. The legal materials must be reproduced accurately, and Crown copyright in the legal materials must be acknowledged.."
All ebooks published by Mandamus Publishing are Copyright © by Mandamus Publishing 2016 in respect of the additions and deletions to the source code as published online and in respect of the navigational features introduced into the text of the Statutes and Regulations. Reproduction in whole or in part of any ebook, regardless of publishing format, is prohibited, except that purchasers are allowed to copy and store multiple copies of any ebook purchased by them, on their own personal electronic devices, which may include multiple computers, tablets or smartphones, but are not entitled to reproduce any ebook or transmit any ebook in any form or by any means to any other person. Notwithstanding the foregoing, there is no restriction on the printing of the content of any ebook or portion thereof, and the provision of that printed copy to any person.
The pricing of these ebooks is not confidential. Except for some exceptionally large ebooks, pricing is based on dividing the ebooks by size into three groups and pricing the groups at $5.00, $10.00 and $15.00.
We consider this a reasonable price for convenient, instant, anywhere, anytime, any device access to an act or regulation which you need to refer to. Mandamus considers that disclosure of this pricing information is a form of marketing assistance for Mandamus. Please broadcast this to any person querying the source and cost of any ebook.
AMENDMENT OF TERMS
The Terms and Conditions of sale, including with respect to price may be amended by Mandamus Publishing Inc. at any time and from time to time. The Terms and Conditions in effect at the time of any purchase shall apply to that purchase in the event of any ambiguity.
What We Collect:
This website does not collect personally identifiable information except during the creation of an account. To sign up for inclusion on the mailing list, we ask you for an email address. For technical support involving the site, we may ask you to provide an email address.
We do not believe that an e-mail address is "personally identifiable information", but we will not sell or otherwise use any email addresses we collect for any purpose not related to this site.
We will ask you to create an account, when you make a purchase. We will ask for your name, address, organization, telephone number and e-mail address. The e-mail address you that provide will be used for the delivery of the ebooks which you purchase. Your purchases will be delivered to that address by way of an attachment to an email.
When you create your account, you will also be asked to create a password for your account. Students will be asked to provide evidence of their current student status, in order to qualify for a student discount.
What We Do With It:
We only use the information to complete orders, to determine status, and to allow us to track our sales, geographically, by organization and temporally. We do not share this information with third parties. We do not use or share the personally identifiable information in ways unrelated to the sales of our products.
We believe that we have instituted appropriate measures to keep the information we collect secure from unauthorized access. The web site and its databases are hosted in secure facilities, and all backups are secured.
Credit Card Data:
We do not directly collect credit card data. All on-line credit transactions are presently handled only through PayPal, which interfaces with Visa or Mastercard on our behalf. No personally identifiable data about you or your credit card is made available to us. We are only (electronically) advised that a transaction has been approved or denied.
Correcting Your Information:
You can login to and access your account to revise your personally identifiable information at any time.
Access to Information By Others:
We will not provide information to nor remove any information regarding sales transactions at the request of any outside party, except under court order.
